A 70-year-old Malibu woman settled her lawsuit against Marina del Rey Hospital, in which she alleged she had to give up her work as a top-flight caterer after an unusual accident in which she was hit by a door at the medical center that rapidly closed, thrusting her onto the hard surface outside where she broke a hip.
Lawyers for Stephanie Tanous filed papers Oct. 7 in Santa Monica Superior Court lawsuit stating that the case was resolved. No terms were divulged.
The suit was filed in Los Angeles Superior Court in August 2017, alleging negligence, premises liability and strict products liability and seeking unspecified damages. The case was later transferred to Santa Monica Superior Court.
Tanous operated a catering business before the accident and counted among her clients many high-profile corporations in Los Angeles County, according to her suit.
In their court papers, defense attorneys hospital stated that Tanous had health problems before the hospital incident, including severe arthritis. They stated that it is incorrect for her to claim she had an active lifestyle before her accident.
“Such is comical, as this was not occurring immediately prior to the incident at issue in this lawsuit,” the defense attorneys stated in their court papers. “In fact, plaintiff even admitted in her own deposition testimony that she stopped the bulk of her catering in 2005, when her mom was dying.”
According to the suit, Tanous went to Marina del Rey Hospital on June 13, 2017, to visit a friend who was in critical condition and for whom the plaintiff served as a patient advocate.
“As Tanous was leaving the hospital, the automatic sliding door between the lobby and the parking lot slammed shut with great force, struck Tanous on the shoulder and catapulted her onto the concrete outside the hospital,” according to her complaint. “Tanous was screaming, crying and immobile.”
The hospital staff put Tanous onto a gurney and gave her morphine. She was later transferred to California Rehabilitation Institute, where a metal rod was put in her injured leg, the suit stated.
